Decree respecting solid waste removal in the Montréal region summary

The purpose of this document is to outline the decree. This is a summary that does not include all the articles of the decree. For the full version, we invite you to visit our website.

  • 1. Class of employment
    • a. Class A employee
      • i. Employee who has worked over 500 hours for his employer
    • b. Class B employee
      • i. Employee who has not worked over 500 hours for his employer
  • 2. Wages:
    • a. Employees must receive the salary corresponding to the type of work they do and the type of truck they use. The salary scale is available on the website.
    • b. The hourly rates must be increased by 0,20$ for shifts beginning after 1:00 pm. This is applicable only to commercial collection.
  • 3. Regular week
    • a. The first 40 hours are paid at regular rates with the exception of hours of a day longer than 12 hours.
    • b. The hours worked after 40 hours or after 12 hours in the same day (The 12 hours rule only applies if the employee worked less than 40 hours in the week) must be paid at 1,5 times the hourly rate.
    • c. Hours worked on Sunday are paid at a rate of 2 times the normal hourly rate. Hours worked on Sunday do not count in the regular work week.
  • 4. Minimum hours
    • a. If called to work, an employee must receive at least 4.5 hours
    • b. This is only applicable if the employer tells the employee to leave. (ex : shortage of work, end of collection, etc.) If the employee asks to leave, the 4,5 hours rule do not apply.
  • 5. Breaks
    • a. The employee can take a paid 10 minutes break.
    • b. The employee is entitled to a lunch break after 5 hours worked. The lunch break is not paid unless the employee is required to stay on site.
  • 6. Holidays
    • a. The class A employee is entitled to the following holidays: January 1st and 2nd, Good Friday or Easter Monday, the Monday preceding May 25th, June 24th, July 1st , Labour Day, Thanksgiving, December 25th and 26th.
      • i. Nine (9) hours must be paid for each holiday. The 9 hours count in the regular week and can result in overtime.
    • b. Class B employee is entitled to the following holidays: January 1st and 2nd, Good Friday or Easter Monday, June 24th , July 1st, Thanksgiving, December 25th and 26th.
      • i. The related indemnity for these holidays is equal to 1/20 of the hours worked in the 4 previous weeks. The maximum to be paid is 8 hours. The hours will not count toward the regular work week and will not result in overtime.
  • 7. Vacation
    • a. The employee who, on 1 January, has less than 1 year of continuous service with his employer, is entitled to 1 day of vacation with pay per month of continuous service but the vacation cannot exceed 2 weeks. The vacation pay is 4% of the employee’s earnings during the qualifying period.
    • b. The employee who, on 1 January, has 1 year of continuous service with his employer, is entitled to 2 continuous weeks of vacation pay equal to 4% of the employee’s earnings during the qualifying period.
    • c. The class A employee who, on 1 January, has 3 years of continuous service with his employer, is entitled to 3 continuous weeks of vacation with pay. The vacation pay is equal to 6% of the employee’s earnings during the qualifying period.
    • d. A class A employee who, on 1 January, has 14 years of continuous service with his employer, is entitled to 4 weeks of vacation with pay. The vacation pay is equal to 8% of the employee’s earnings during the qualifying period.
  • 8. Group insurance
    • a. All employees having reach the Class A has to be insured under the Comité Paritaire group insurance. The employer can offer his own group insurance, but the coverage should be at least equal to the one the Comité offers. The price paid by the employee should not be higher that what would be paid under the Comité’s coverage. The group benefits need to be approved by the Comité.
  • 9. Advance notice
    • a. Dismissed or layoff employee:
      • i. No notice is payable if the employee has worked less than 3 months for the employer.
      • ii. Employee who worked between three (3) months et twelve (12) months is entitled to one (1) week of notice.
      • iii. Employee who worked between one (1) year and five (5) years is entitled to two (2) weeks of notice.
      • iv. Employee who worked between five (5) years and ten (10) years is entitled to four (4) weeks of notice.
      • v. Employee who worked for more than ten (10) years is entitled to 8 weeks of notice.

Définition

Self-loading truck:

The self-loading or robotic truck is a vehicle that will mechanically lift the bin or container, without the physical assistance of the driver.

The loading is done in an automated way. The driver performs the maneuver inside the truck or on the side of it by manipulating levers.

This vehicle occasionally requires physical and manual intervention by the driver.

Side-loading truck:

The side-loading truck is a vehicle that requires the manual intervention of the driver to bring the bin to the truck and then perform lifting the container using a manual pourer. The driver must then replace the container at the roadside.

This vehicle requires the physical and manual intervention of the driver for all lifts.

Other vehicule:

Any other type of truck assigned to the collection of residual materials that is not part of self-loading or side-loading trucks. ( ex: Rear-end loading truck, Cube truck, modified pick up, etc.)
