Regulations of the Comité paritaire of Refuse Collectors of the Montreal Region concerning the maintenance of a register, the monthly report and the levy

An Act respecting collective agreement decrees (chapter D-2, a. 22,2  ͤ  al.,  par. g,h et i, sous-par. 2 à 4)

SECTION I 

GENERAL PROVISIONS

1. Any professional employer governed by Decree respecting the solid waste removal in the Montréal region (R.R.Q., 1981, c. D-2, r. 29) shall keep a register in which are shown the complete name, address and social insurance number of each employee in his employ, his competency or classification, the exact hour at which work has begun, interrupted, resumed, and ended each day, the nature of the work and wage paid, including any additional amounts with mention of the method and time of payment.

2. Any professional employer shall use a punch-clock or a time-sheet, approved by the Comité paritaire and signed daily by every employee.

3. All registers are kept at the employer’s business place and are at the Committee’s disposal.

 

SECTION II

KEEPING A REGISTER

4. The employer must maintain a register in which the following information is recorded for each employee:

their surname and first name, date of birth, address, social security number,

job classification, date of first day worked, and the following information, where applicable, for each pay period:

1° the number of working hours per day, including the hour at which the work was started, interrupted, resumed, or completed for each day, as well as the nature of the work;

2° the total of regular and overtime hours worked per week;

3° the number of overtime hours paid or compensated with leave with the applicable premium;

4° the number of working days per week;

5° the hourly wage rate;

6° the nature and amount of bonuses, allowances, benefits, or commissions paid;

7° the amount of gross salary;

8° the nature and amount of deductions made, including the amount of group insurance premiums;

9° the amount of net salary paid to the employee;

10° the work period corresponding to the payment;

11° the date of payment and the method of payment of the salary;

12° the reference year;

13° the date of departure for annual paid leave and the duration of this leave;

14° the date on which the employee benefited from a paid public holiday or another day off, including compensatory leave related to paid public holidays.

The register must also contain an up-to-date list of all the locations where work subject to the decree is carried out, as well as the activity reports maintained in accordance with the Regulation on Driving and Rest Hours for Heavy Vehicle Drivers (Chapter C-24.2, r. 28).

5. Every professional employer uses a time clock or an attendance sheet, approved by the Comite paritaire, which each employee signs daily.

6. The professional employer completes and keeps a job card for each employee. These cards are provided by the Comite paritaire and signed jointly by the employer and the employee within 7 days following the date of hire of each employee.

7. The register must be kept at the principal establishment of the professional employer. The information contained in the register relating to a given year must be kept for a period of 3 years following that year.

SECTION III

MONTHLY REPORT

8. The professional employer must submit in writing to the Comité paritaire,

using the form provided in Appendix I, a monthly report indicating the following information:

1° the last name and first name of each employee in their job, their address,

their social insurance number, their classification, the number of regular and overtime hours they worked each week, the total of these hours, their hourly rate, and the total of their earnings;

2° the allowances paid to each employee for annual leave and paid holidays, and any other allowance or benefit with a monetary value;

3° the monthly premium payable jointly by the employer and the employee to the Comité paritaire according to the group insurance plan.

9. The monthly report is signed by the professional employer or an authorized representative and must be sent to the headquarters of the Comité paritaire no later than the 10th day of the following month. The professional employer must submit a report for every monthly work period, even if no work was performed by themselves or by their employees.

10. The monthly report can be sent by mail or by any means using information technology.

However, the means using information technology used by the professional employer must be previously authorized by the Comité paritaire to ensure that it is compatible with the technological equipment it possesses.

 

SECTION IV

WITHDRAWAL

11. The contribution rate set by the Comité paritaire is:

1° in the case of a professional employer, 0.50% of the gross wages paid to their employees subject to the decree;

2° in the case of an employee, 0.50% of their gross salary;

3° in the case of an artisan who is not in the service of a professional employer, $25.00 per month.

12. The professional employer collects the levy imposed under paragraph 2° of Section 11 by means of a deduction from the salaries of its employees at each pay period.

13. The professional employer must remit to the Comité paritaire the levy, payable by both itself and its employees for a monthly period, no later than the 10th day of

The employer must add to the monthly report form provided for in Appendix I the total amount payable by themselves and deducted from their employees for the monthly period.

The contractor who is not employed by a professional employer must submit to the Comité paritaire, no later than March 31, June 30, September 30, and December 31, the amounts due for the 90 days preceding each of these dates, the deduction payable by themselves.

 

SECTION V

FINAL PROVISIONS

14. This regulation replaces the Regulation on the registration system of the Comité paritaire of Cleaners of the Montreal region approved by decree number 4007-80 of December 22, 1980, notice of its adoption having been given by the Comité paritaire on July 2, 1981 (1981, O.G. 2, 2769), the Regulation on the monthly report of the Comité paritaire of Cleaners of the Montreal region, notice of its adoption by the Comité paritaire  having been given by the government on February 11, 1981 (1981, O.G. 2, 547), and the Regulation on the levy of the Comité paritaire of Cleaners of the Montreal region approved by decree number 2626-85 of December 11, 1985, and amended by decree number 607-2015 of June 30, 2015.

15. This regulation comes into force on the fifteenth day following its publication in the Official Gazette of Quebec.
